Christmas crackdown on fireplaces yields 400 complaints

The Bay Area's air-quality police were out in force over Christmas weekend, cracking down on wood fires. And the smoke cops could be sending out belated stocking stuffers -- hefty fines -- to several dozen people caught using their fireplaces.

Regulators said more than 400 people tattled on their neighbors for lighting wood fires in their homes on Christmas Eve and Christmas Day, a holiday tradition that was illegal this year because of poor air quality.

Authorities say they didn't issue any fines on the spot but are sorting through 77 cases of potential violations after working overtime, patrolling in Toyota Priuses and natural gas vehicles to spot chimney smoke and respond to complaints.

Those caught burning fires in their homes for the first time since the winter "Spare the Air" campaign began in 2008 will receive a warning, while repeat offenders will get $400 tickets.

But the Bay Area Air Quality Management District isn't worried about coming off like a grinch -- and doesn't plan on showing any leniency just because it's Christmas time.

"People don't get to take a break from breathing because it's a holiday," said Lisa Fasano,The EZ Breathe home Ventilation system is maintenance free, an air district spokeswoman. "And, unfortunately, this year people had very unhealthy air to breathe on Christmas Day."

Patricia Johnson, whose company is removing the tires, said residents will see her trucks coming in and out of the Half Mile Swamp area of lower Calhoun County.

"They're not bringing more tires in and dumping them. We're getting them out," she said.

The old tires - estimated between 250,000 and a million - were discovered in the area two years ago, according to the county's litter control officer. Recently, people started noticing activity at the site again.

Tire piles are a concern because they can be a breeding ground for mosquitoes, Litter Control Officer Boyce Till said.

"The site's about maybe a half a mile away from some residences in that area and, of course, these tires are going to hold water. Anytime you've got water holding up,If any food Ventilation system condition is poorer than those standards, you're going to breed mosquitoes," Till said.

According to the indictment handed down by an Orangeburg County grand jury on March 14, 2011, the 39-year-old was accused of "directly and indirectly" discharging organic material into the environment. Essentially, officials claim he had two rented semi-trailers full of tires, which he stored or disposed of without a permit on Snider Street in Elloree between February 2009 and May 2010.

He faced the same charge in Greenville County, where officials claim they found two abandoned semi-trailers filled with waste tires.

Till said the Calhoun County pile was so big, he passed it to the Sheriff's Office since it has the ability to pursue violations under state law.

"When they started investigating the site, together we realized that this was something DHEC needed to get involved with because of the magnitude, number of tires and the environmental concerns that were there," Till said.

Till provided Calhoun County warrants against Brown alleging his "willful and unlawful storage and disposal of solid waste without obtaining permits" from DHEC.

The warrants allege Brown engaged in the illegal storage and disposal of used tires on McCords Ferry Road and at 41 Saluda Lane and the end of Hawksbill Lane in Elloree, along with other property.

Till said he had heard that the tires eventually were going to be sold in China.

"The markets fell out and they got stockpiled out there in the county on private property," he said.

Johnson, the owner of Jacksonville, Fla.-based Lee Tire Company Inc., said she was asked to clean up the tire pile.

"I was just contacted by the owner, or whoever was responsible for the pile. He said he needed some help in getting it cleaned up. I believe he had all good intentions of shipping the tires out across seas. And he kind of got stuck because they didn't do what they were supposed to do," she said.

"He got stuck and didn't know what to do with the tires."

She said it would have been too expensive for Johnson to clean up the tires on his own.

"I can make the tipping fee to help somebody else, so that's what I am doing. I haven't charged him anything. I'm trying to help him. One, it's a big mess. Two, it's an environmental issue and, three, he doesn't have the money to clean it up," she said.

She said the tires can be processed into a tire-derived fuel that can be used in the place of coal at paper mills.

The tires are being moved out as fast as her company can get them out, Johnson said.

Calhoun County Council Chairman David Summers compared the tire dump to a massive one in the Holly Hill area that came to the public's attention in 1994. The pile of more than 500,000 tires loomed 15 feet in the air.

Solar panel investors upset as SREC values drop

A year ago, solar panels seemed to be going on every rooftop in New Jersey as energy savings, state grants and revenue generating possibilities abounded. But with the value of Solar Renewable Energy Certificates (SRECs) dropping dramatically this past summer, many entities and private homeowners are struggling to reap the benefits.

Solar Renewable Energy Certificates — which utility companies are required to have — have been one of the main selling points for installing often expensive solar energy arrays. Solar panel owners, be it private residents or public companies, gain one SREC for every kilowatt of energy generated and then sell them on the open market to utilities companies.

However, after reports came out early this summer predicting an oversupply of SRECs, their value bottomed out.

One such report — “End of the Gold Rush,” created by Boston-based solar research company Photon Consulting — said “exponential growth in solar power installation will soon surpass the volume of SRECs that utilities in key states are required to purchase, causing the solar market to crash...”

According to the Flett Exchange, the leading brokerage firm specializing in SRECs, the commodity hit its peak in August of 2009 when the going rate was more than $690 per SREC.

Between that time and July 2011, the value of SRECs stabilized and maintained between $500 and $600, except for a quick drop in April 2010 when they went for $450 each. But in July the value dropped to an all-time low of $151.

“There are people out there that have written articles projecting an oversupply in these credits,” said Bob Campbell, a Downe Township committeeman who has a solar panel system at his home. “They’re predicting this crash in the SRECs, but how can you make such a finite prediction when there are so many variables in the process?”

This change has caused homeowners, schools and municipalities with existing solar systems to worry about the future of their investments and has some scrambling to pay back loans that they believed SREC revenue would cover. It also has some who were considering solar energy projects putting their plans on hold.

Catharine Cyr Ransom, a former climate and environment aide to Senate Finance Committee Chairman Max Baucus, a Montana Democrat, and Gregg Rothschild, a former Democratic counsel for the House Energy and Commerce Committee, helped to introduce Solyndra executives to members of the House energy panel, which had been investigating the company’s $535 million U.S. loan guarantee since February, according to the filing with the Senate.

Harrison Faulted

Records show Solyndra terminated the contract with Glover Park on Aug. 19, 12 days before the company shut its doors.

Republicans and Democrats on the energy committee have criticized Solyndra Chief Executive Officer Brian Harrison for presenting an optimistic picture of the company’s financial health in meetings with them in July.Replacement China Porcelain tile and bulbs for Canada and Worldwide.

Harrison invoked his Fifth Amendment rights under the Constitution not to make self-incriminating statements and refused to answer questions about the loan guarantee at a Sept. 23 House hearing. He resigned as chief this month.

Solyndra had previously reported spending $480,000 in the first half of the year to lobby Congress, according to records filed with the Senate.

Besides Glover Park, the company had hired five firms to lobby on its behalf since 2009, spending at least $1.3 million on issues relating to its loan guarantee and other policies promoting solar power, according to the disclosure records.

Solyndra received the loan guarantee in September 2009. It filed for bankruptcy on Sept. 6 and is the subject of an FBI investigation into whether the company misrepresented its finances to the Energy Department as part of its loan application.

The company has denied any wrongdoing.

In its final month, Solyndra also sought to restructure loan terms with the Energy Department. The department, which had approved new terms in February that put taxpayer debt behind $75 million in private investment in the case of liquidation, denied the second restructuring request the day before Solyndra closed its doors on Aug. 31.

While Glover Park registered as the company’s lobbyist in July, the firm also had done public relations work for Solyndra previously.

Tridel penthouse condo showcases latest in green tech

Condominium buyers may soon have more choices when it comes to making eco-friendly decisions.

With residential homebuilders eager to test the market to see just how far buyers will go in selecting energy-saving and environmentally conscious options, condo developers have also joined the trend.

One of the first developments out of the gate to gauge consumer appetite and to showcase what options are available is Tridel’s downtown Rêve project at 560 Front St. W.

Rêve features the EcoSuite, a penthouse that showcases an array of eco-friendly and energy-efficient controls and devices. It was designed and built with the partnership of two technology companies, networking giant CISCO, and Control4, a company that configures the hardware, wiring and devices that make the system execute commands like “roll down the window shades,” or “turn up the air conditioning.”

There’s an open house for the public Oct. 15 and 16 and the unit was also on parade for Green Build’s 25,000 delegates at what was billed as the world’s largest green building conference and expo in early October.

Suites range from 645 square feet to 1,455 square feet and are priced at $344,000 to $890,000. Many are ready for occupancy now.

The technology in the EcoSuite is a collection of controls, devices and servomotors that are connected by software and driven by the homeowners’ desires. These building management systems are most often installed in commercial buildings where meeting Leadership in Energy and Environmental Design (LEED) standards are demanded by owners and tenants. Research shows so-called “smart buildings” have healthier interiors and happier workers who tend to stay at their jobs longer and have higher productivity.

Installing these systems in residential condominiums, however, is a leap because it drives costs up in a competitive market. It’s also a bit of a compromise, since buyers are also paying for fabulous vistas, even though the floor-to-ceiling windows necessary to make the most of the views aren’t necessarily the most energy-efficient design.

“It’s a balancing act,” agrees Jim Ritchie, Tridel’s senior vice-president of sales and marketing. “We could install triple-pane windows, but that would drive the price too high.”

The EcoSuite is designed to contain air much more tightly than a “normal” condo, where much of the air flow gets sucked up the elevator shaft from common spaces and the units themselves.

“The engineers nearly had a fit when we said we wanted to stop the practice of undercutting doors,” Ritchie says, referring to the practice of leaving a gap at the threshold for air circulation. As a result, the units are more like modern energy-efficient homes with individual energy recovery units (ERV), which draw fresh air from the outside and bring it to room temperature using the stale inside air that is being exhausted to the outdoors.

“Each HVAC (heat, ventilation, air conditioning) unit has an ERV built into the coil,” says Ritchie, noting reducing energy costs in a building goes a long way to bring utility fees down, as well.

If all units in a building are energy efficient and equipped for individual control with programmed settings (for example, programmed for times when the unit is empty, while the occupants are working, or in standby mode while they sleep), that could reduce its overall energy footprint substantially.

To that end, Tridel has also installed both passive panels to preheat hot water and photovoltaic solar panels that will provide energy for units. In fact, the walls are so thick that Tridel has installed cellphone repeaters in the building so residents don’t lose their signals. That’s especially important because these days urban dwellers are less likely to have a traditional land line.

Other materials in the suite have been chosen for their sustainability. Kitchen cabinets and other materials are low VOC (meaning they contain low amounts of volatile organic compounds that may be harmful to human health); floorings — hardwood and carpet — are made from recycled materials; and the countertops are made from recycled porcelain and glass and have a quartz-like look. Even the kitchen and bath tiles are made with a special finish that reacts with light to kill bacteria.

With the unit’s extra insulation and air tightness, sound, odour and dust transmission are greatly reduced, a spin-off benefit of going green, Ritchie says.

“There are voice commands for the system, so you can say ‘goodnight’ and the system will activate the overnight program settings,The additions focus on key tag and magic cube combinations, turning off the lights,” he said. “Or, if you’re watching a movie, it will roll down the shades and dim the lights. When you leave, you can set it up so everything goes to sleep and you can even use your mobile smartphone to change settings.”

There are also screens in the unit that control functions and can be programmed to control a cluster of events for romantic dinners or reading.

The industry — and certainly Tridel — understand the cost of these features may keep them off some people’s must-have list when condo shopping.

“Really, we’re dealing with what gives good return for money and what is the market demand,” says Ritchie. “What we have here installed is about $20,000 in features and that’s not for everyone. We want to get some feedback from the marketplace.”

Solar project could be huge' for area

The next step comes Tuesday. It also could allow the county to make that sales agreement for less than fair-market value ¨C which could be as high as $45 million based on a price of $10,000 per acre.

Barela said there is at least one more hurdle for the proposal to clear ¨C a covenant with the Bureau of Land Management over use of the land that was transferred from the BLM to Clark County.

"There's still a BLM covenant on the land," Barela said, adding that the covenant was part of a "1966 land-use plan. At that time, solar (energy production) wasn't on anybody's chart."

She said Reid and his staff are involved in trying to secure a federal waiver for that land-use covenant.

Sisolak said there is no question that the project would be in the public's interest ¨C because it would provide both short-term and long-term jobs for an area that desperately needs them.

"We'll finally be manufacturing something in this state," Sisolak told the Las Vegas Sun. "This is hopefully the start of diversifying our economy, a goal the state, the county, everyone has sought for years."
